Landlords engaging our services confirm that:

• They have the legal right to let the property

• The property complies with all applicable UK legislation, including gas safety, electrical safety, energy performance, and fire safety requirements

• They will maintain appropriate insurance cover

7. Fees and Payments

All fees charged by Summersmith Lettings will be clearly disclosed before any service is provided and in accordance with the Tenant Fees Act 2019.

Any permitted fees payable by tenants or landlords will be outlined in writing.

8. Deposits

Tenant deposits will be protected in a government-approved tenancy deposit scheme in accordance with UK law. Prescribed information will be provided within the required timeframe.

9. Data Protection and Privacy

We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

10. Complaints

Fees for letting, tenant-find, property management and additional services will be agreed with the landlord in writing before the relevant services commence. The applicable fees, payment arrangements and any additional charges will be detailed in our Landlord Terms of Business or other written agreement.

15.2 Payment Terms

Invoices issued by Summersmith Lettings must be paid by the due date specified, unless alternative payment arrangements have been agreed in writing.

Where authorised under the relevant management agreement, fees may be deducted from rental income collected on behalf of the landlord.

15.3 Late Payments

Where an invoice remains unpaid after its due date, Summersmith Lettings reserves the right to charge interest and recover applicable debt recovery costs where permitted by law and the relevant agreement.

15.4 Recovery of Outstanding Balances

Where payment remains outstanding, we reserve the right to pursue recovery through appropriate lawful means, including formal debt recovery procedures or court proceedings where necessary.

15.5 Disputed Invoices

Any questions or disputes regarding invoices should be raised as soon as reasonably possible by emailing info@summersmith.co.uk. We will investigate any concerns and seek to resolve them fairly and promptly.

15.6 Tenant Payments

Any payments requested from tenants or prospective tenants will comply with the Tenant Fees Act 2019 and other applicable legislation.

Rent, deposits and other permitted payments will be governed by the relevant tenancy documentation and applicable law.

15.7 Existing Agreements

Nothing in these Terms overrides any existing signed agreement, statutory rights or legal protections. Where a separate written agreement applies, its terms will take precedence in relation to the services covered by that agreement, subject to applicable law.
